These Terms and Conditions ("Terms") govern your relationship with the operator of the online casino platform available at https://spirit-au.com and any associated Australian-facing mirrors (the "Website"), branded for the purposes of this project as Spirit Casino ("Spirit Casino"). By accessing or using the Website and any related services (together, the "Services"), you agree to be bound by these Terms.
The Services are operated by Complete Technologies N.V., a company registered in Curaçao, which holds an online gambling sublicense issued under Master License 8048/JAZ by Antillephone N.V. Payment processing services for certain transactions may be provided by Bovive Ltd, a company registered in Cyprus.

Nothing in these Terms is intended to exclude or limit any non-excludable rights you may have under applicable law, including (where applicable) the Australian Consumer Law. You are solely responsible for ensuring that your use of the Services is lawful in your jurisdiction.

Definitions
For the purposes of these Terms, the following terms shall have the meanings set out below:
- Operator means Complete Technologies N.V., registered in Curaçao under number 154512, operating the Website under online gambling sublicense 8048/JAZ2014-044 issued by Antillephone N.V., and, where relevant, its payment processing affiliate Bovive Ltd (Cyprus, reg. no. HE424520).
- Website means the online casino platform available at https://spirit-au.com and any other domains, subdomains, or mirrors that the Operator designates as subject to these Terms and that provide access to the same gaming environment.
- Services means all products and services provided via the Website, including but not limited to casino games, live casino, promotional offers, account facilities, payment processing, and customer support.
- User or Player means any natural person who accesses the Website, whether or not they register an Account or place a Bet.
- Account means a personal online account registered by a Player on the Website for the purpose of using the Services.
- Game means any casino, live casino, instant win, or other game made available on the Website by the Operator or its game providers.
- Bet or Wager means any stake of money or digital assets placed by a Player on the outcome of a Game or event offered on the Website.

- Real Money Balance means funds deposited by a Player and any resulting cash winnings, minus withdrawals and fees.

Account Registration
Eligibility and Age Requirements
- Minimum age: You may only register an Account and use the Services if you are at least 18 years old (or older if the legal gambling age in your place of residence is higher). By creating an Account, you confirm that you meet this requirement.
- Jurisdictional restrictions: You must not use the Services if it is illegal to do so under the laws applicable to you. In particular, Australia's Interactive Gambling Act 2001 regulates the offering of interactive gambling services; while it primarily targets operators, you remain responsible for checking whether your use of offshore gambling services is lawful. - KYC and identity checks: At any time (and particularly before permitting withdrawals, certain deposit levels, or high-value Bets), the Operator may request KYC documentation, which may include:

User Obligations and Account Security

- Password and access details: You are solely responsible for keeping your login credentials confidential and secure. You must:
- Choose a strong, unique password;
- Not share your credentials with any third party; and
- Notify the Operator immediately via the Website's support channels if you suspect any unauthorised access to your Account.
- Use of Account: Your Account is for your personal, non-commercial use only. You must not act on behalf of others, share your Account, or use your Account as a pool or syndicate bankroll.
Verification, Restrictions, and Responsible Gambling
- Verification outcomes: The Operator may, at its discretion and in line with legal and licensing requirements:
- Limit deposits or Bets pending verification;
- Freeze Bonuses and related winnings;
- Block withdrawals until checks are complete; or
- Close your Account if information is false, misleading, or inconsistent.
- Responsible gambling measures: The Operator encourages responsible gambling and may make available tools such as deposit limits, loss limits, session limits, and self-exclusion. Betting & Gameplay Rules
General Rules for Placing Bets
- Game rules: Each Game available on the Website is governed by its specific rules and pay tables, as displayed within the Game client or help section. By placing a Bet, you confirm that you have read and understood the applicable rules.
- Minimum and maximum Bets: Minimum and maximum Bets for each Game or table are displayed in the Game interface or lobby. The Operator may change these limits at any time, and such changes will take effect when published in the Game or lobby.
- Bet acceptance: A Bet will be deemed accepted when it is recorded on the Operator's servers. If a network interruption or other error occurs after you initiate a Bet but before confirmation, the Operator's server logs will determine whether the Bet was accepted and its outcome.
- Bet modification and cancellation: Once placed and accepted, Bets generally cannot be cancelled or modified. Any exception (for example, where explicitly allowed by a Game's interface) will be clearly indicated in that Game's rules.
Technical Errors, Malfunctions, and Disconnections
- Malfunctions: If a Game or system malfunction occurs, all affected Bets and winnings may be voided. In such cases, the Operator's decision based on server logs and game-provider records will be final, subject to any applicable dispute procedure.
- Display errors: Apparent errors in displayed balances, odds, or pay tables (for example, an obviously incorrect jackpot amount) do not create an entitlement to payment. The Operator is entitled to correct any such error and adjust affected Bets and balances to the amounts that should have been applied.
- Disconnections: If you are disconnected during a Game, the outcome may:
- Be played to completion in your absence (for example, a slot spin), with the result applied to your Account; or
- Allow you to resume the Game from the same state after reconnection, where supported by the game provider.
Conduct, Collusion, and Fair Play
- Prohibited conduct: You must not:

Bonus Terms
General Bonus Principles
- Separate Bonus terms: All Bonuses, including welcome offers, free spins, reload bonuses, cashback, loyalty rewards, tournaments, and any other promotion on spirit-au.com, are governed by:
- These Terms; and
- The specific terms and conditions for each promotion, as displayed on the relevant promotional page and, where applicable, the dedicated Bonus terms page at https://spirit-au.com/bonus-terms.
- Eligibility: Bonuses may be restricted by country, Payment Method, player status, or other criteria. The Operator may exclude certain jurisdictions or categories of players from specific offers, including where required by law or licensing conditions.
Bonus Activation and Wagering
- Activation: Bonus activation may require:
- Opt-in via the cashier or promotions page;
- Entering a bonus code; and/or
- Making a qualifying deposit of a minimum amount specified in the offer.
- Wagering requirements: Unless explicitly stated otherwise, Bonuses and any winnings generated from them are subject to wagering requirements before they may be withdrawn. Refunds and Adjustments Relating to Bonuses
- Cancellation by Player: You may usually cancel an active Bonus through the Website's cashier or by contacting support. Cancelling a Bonus will typically result in the loss of the Bonus and any winnings generated from it that have not yet been converted to your Real Money Balance.
- Technical or clerical errors: If a Bonus is credited in error, the Operator may remove or adjust the Bonus and any associated winnings. In such cases, the Operator will act reasonably and may notify you of any significant adjustment.

Deposit Methods and Processing

Refunds, Chargebacks, and Reversals

- Payment processors: Some payment services may be provided by Bovive Ltd (Cyprus) or other authorised payment processors acting on behalf of the Operator. By making deposits or withdrawals, you authorise such third parties to process transactions in line with their terms and applicable law.
- Banking restrictions in Australia: Australian financial institutions may, under local regulation and internal policies, block or refuse certain payments related to offshore gambling sites. This may affect your ability to deposit or withdraw via particular methods. The Operator is not liable for such blocks or refusals but may offer alternative methods such as PayID or cryptocurrencies where lawful and technically feasible.
Limitation of Liability
Operator's Obligations and Service Quality
- Fairness and integrity: The Operator aims to provide Games that are fair and operate as described. Many Games are supplied by third-party providers using certified random number generators (RNGs) or other approved mechanisms. Where applicable, testing and certification may be carried out by independent laboratories in accordance with Curaçao licensing requirements.

Exclusions of Liability
- General exclusion: To the maximum extent permitted by Applicable Law, the Operator, its affiliates (including Bovive Ltd), and its service providers shall not be liable for:
- Any indirect, incidental, special, punitive, or consequential loss or damage;
- Loss of profits, business, opportunity, goodwill, or data; or
- Any loss arising from your failure to comply with these Terms.
- Technical and network failures: The Operator is not responsible for:
- Technical failures of hardware, software, or internet connections, whether on your side or affecting networks or infrastructure beyond the Operator's control;
- Interruptions due to maintenance, upgrades, or emergency repairs; or
- Regulatory or governmental actions, including blocking orders or DNS restrictions (for example, by the Australian Communications and Media Authority or other authorities) that may impact your ability to access the Website.
- Third-party actions: The Operator is not liable for acts or omissions of third parties, including payment providers, banks, telecom operators, ISPs, or game providers, except where such liability cannot be excluded under Applicable Law.
Limitation of Maximum Compensation
- Cap on liability: Subject always to the paragraph below and to any non-excludable statutory rights you may have (including, where applicable, under the Australian Consumer Law), the total aggregate liability of the Operator to you for any claim arising out of or in connection with the Services or these Terms (whether in contract, tort, negligence, or otherwise) shall be limited to the higher of:
- The amount of the Bet or transaction that gave rise to the claim; or
- Your net deposits (deposits minus withdrawals) made into your Account during the six (6) months immediately preceding the event giving rise to the claim.
- Non-excludable rights: Nothing in these Terms operates to exclude, restrict, or modify any guarantee, condition, warranty, right, or remedy implied or imposed by any Applicable Law that cannot be lawfully excluded, including any non-excludable consumer guarantees that may apply under the law of your country of residence. Where a guarantee or warranty is implied or imposed by law and may not be excluded but the Operator's liability for a breach may be limited, the Operator's liability will be limited, at its option, to:
- Re-supplying the relevant services; or
- Paying the cost of having the services re-supplied.
Intellectual Property Rights
Ownership of Content and Software
- Proprietary rights: All rights, title, and interest in and to the Website and Services, including all software, source code, databases, game content, graphics, audio, video, text, logos, trademarks, trade names, and other materials, are owned by the Operator or its licensors and are protected by copyright, trade mark, and other intellectual property laws.
- Limited licence: Subject to your compliance with these Terms, the Operator grants you a personal, non-exclusive, non-transferable, revocable licence to access and use the Website for your private, non-commercial entertainment purposes only.
Prohibitions
- No copying or distribution: You must not copy, reproduce, modify, adapt, distribute, transmit, publicly display, publicly perform, resell, or otherwise exploit any part of the Website or its content without the prior written consent of the Operator or the relevant rights holder.
- No reverse engineering: You must not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software used in connection with the Services, except to the extent permitted by Applicable Law and only after giving prior written notice to the Operator.
- Third-party marks: Any third-party brand names, logos, and trademarks appearing on the Website are used for identification purposes only and remain the property of their respective owners. No licence or right is granted to you in respect of those marks.
Privacy & Data Protection
- Privacy Policy: The Operator collects and processes personal data in connection with the Services. By using the Website, you acknowledge that your personal data will be processed in accordance with the Operator's Privacy Policy as published on the Website (for example, via a link such as "Privacy Policy" in the footer). You should read that policy carefully before using the Services.
- Purposes of processing: Personal data may be used for account management, KYC and AML checks, payment processing (including via Bovive Ltd or other processors), responsible gambling tools, fraud prevention, service improvement, and compliance with legal and regulatory obligations.
- International transfers: As the Operator is based in Curaçao and utilises international payment processors and service providers, your data may be transferred to and processed in countries outside your country of residence. Appropriate safeguards are applied where required by Applicable Law.

Changes to Terms
Amendment Procedure
- Right to modify: The Operator may amend these Terms at any time to reflect changes in law, regulatory requirements, industry practices, technical developments, or the Operator's business operations (including the addition of new Services).
- Notification: Where changes are material, the Operator will use reasonable efforts to notify you in advance by one or more of the following means:
- Posting the updated Terms on the Website, with an updated "Last updated" date;
- Displaying a prominent banner or pop-up notice on the Website; and/or
- Sending an email or in-account message to the email address or inbox associated with your Account.
- Effective date of changes: Changes will take effect on the date specified in the notice or, if no date is specified, upon publication on the Website. Continued use of the Services after the changes take effect will constitute your acceptance of the updated Terms.
Right to Discontinue Use
- If you do not agree: If you do not agree to any amended Terms, you must stop using the Website and Services immediately and close your Account. In such case:
- These Terms (as previously accepted) will continue to apply to any outstanding obligations or disputes arising before the effective date of the amendments; and
- You may request withdrawal of your eligible Real Money Balance in accordance with the then-current withdrawal rules.
Termination & Suspension
Termination by the Player
- Account closure: You may request closure of your Account at any time via the Website's account settings or support channels. After closure:
- You will no longer be able to access the Services using that Account; and
- You may request withdrawal of any remaining eligible Real Money Balance, subject to verification and applicable rules.
- Self-exclusion: Where self-exclusion tools are offered, you may choose to self-exclude for a defined or indefinite period. During self-exclusion, you must not attempt to open new accounts or otherwise circumvent restrictions.
Termination or Suspension by the Operator
- Grounds for action: The Operator may suspend or terminate your Account, restrict your access to the Services, or freeze funds where it reasonably believes that:
- You have breached these Terms (including Bonus or Game rules);
- You have provided false or misleading information, failed KYC checks, or refused to provide requested documentation;
- Your use of the Services may be illegal under Applicable Law (including, where relevant, the Interactive Gambling Act 2001 in Australia) or may expose the Operator to legal risk;
- You have engaged in fraud, money-laundering, collusion, Bonus abuse, or other prohibited conduct; or
- A regulator, law enforcement agency, court, or payment provider has requested or required such action.
- Consequences of termination: In the event of termination:
- Access to your Account and the Services will be revoked;
- Bonuses and Bonus-derived winnings may be cancelled; and
- Your remaining Real Money Balance will be handled in accordance with Applicable Law and these Terms. Where termination is due to a serious breach or unlawful activity, funds may be frozen, confiscated, or remitted to authorities if required by law.
- Notification: The Operator will use reasonable efforts to notify you of the reasons for any suspension or termination, except where prohibited by law or if doing so would compromise an investigation.
Dormant and Inactive Accounts
- Dormant Accounts: An Account may be considered dormant after a prolonged period of inactivity (for example, 12 months with no login or transaction), as defined in the Operator's policies. The Operator may:
- Contact you using the last known contact details;
- Charge a reasonable administrative fee, where permitted by law and clearly disclosed; and/or
- Close the Account and handle any remaining balance in accordance with Applicable Law and internal policies.
Governing Law & Jurisdiction
Applicable Law
- Primary governing law: These Terms, your use of the Website, and all disputes arising out of or in connection with the Services are governed by the laws of Curaçao, without regard to its conflict-of-laws rules.
- Mandatory protections: Notwithstanding the above, you may benefit from mandatory consumer protection or other non-excludable laws of your country of residence (including, where applicable, the Australian Consumer Law). These Terms are not intended to limit such protections.
Dispute Resolution
- Internal complaints process: If you have a complaint, you should first contact the Operator's customer support via the channels provided on the Website, providing full details of your claim. The Operator will investigate and endeavour to respond within a reasonable timeframe.
- Escalation to regulator (Curaçao): If you are not satisfied with the Operator's response, and if your complaint relates to matters falling within the Curaçao license framework, you may be able to escalate the matter to the relevant Curaçao authority for review in accordance with their procedures. Information about licence validation is available at https://validator.antillephone.com, and complaints relating to Curaçao-licensed operators may be directed to the relevant dispute contact as listed on https://gaming-curacao.com (for example, [email protected]), noting that this is an external regulator contact and not operated by the Operator.
- Court jurisdiction: Subject to any mandatory rights you may have under Applicable Law, you agree that the courts of Curaçao shall have non-exclusive jurisdiction to hear and determine any dispute or claim arising out of or in connection with these Terms or their subject matter.
Australian Law Context
- Regulatory framework: The offering of interactive gambling services to persons in Australia is regulated under the Interactive Gambling Act 2001 and related instruments. Enforcement actions (including blocking of offshore gambling websites) are primarily directed at operators and service providers. However, you are responsible for understanding how Australian law applies to you personally.
- No legal advice: References to Australian legislation and authorities (including https://www.legislation.gov.au and https://acma.gov.au) are provided for information only and do not constitute legal advice.
